2. Service Description and Limitations
2.1 What the Service Is

- For higher subscription tiers, provides document organization assistance from trained service staff.
2.2 What the Service Is NOT
This is the most important section of these Terms. You must understand what Beacon Tax Relief LLC does not do.
(a) Not Legal Advice. Nothing in the Service, including AI-generated responses, educational content, document templates, staff communications, or any other output, constitutes legal advice. Beacon Tax Relief LLC does not provide legal advice. If you need legal advice, consult a licensed attorney.
(b) Not Tax Advice. Beacon Tax Relief LLC does not provide personalized tax advice. Information provided by the Service is general and educational in nature and does not constitute professional tax advice tailored to your specific situation.
(c) Not IRS Representation. Beacon Tax Relief LLC does not represent you before the IRS, the U.S. Tax Court, or any other taxing authority. Beacon Tax Relief LLC does not negotiate with the IRS on your behalf. Beacon Tax Relief LLC does not execute any agreements, settlements, or payment plans with the IRS. All communications with the IRS are your sole responsibility.
(d) Not a Debt Settlement Service. Beacon Tax Relief LLC is not a debt settlement company. We do not settle debts on your behalf. We do not renegotiate, adjust, or alter the terms of any obligation owed to the IRS or any other creditor on your behalf.
(e) Not a Credit Counseling Service. Beacon Tax Relief LLC is not a credit counseling organization.
(f) No Outcome Guarantee. Beacon Tax Relief LLC makes no representation, warranty, or guarantee that any IRS program, offer, agreement, or resolution will be approved, accepted, or successful. All IRS outcomes depend entirely on your individual financial circumstances, IRS determinations, and IRS discretion. Your use of the Service does not increase or guarantee any particular result.

3. We Are Not Your Representative — Prominent Disclosure
THIS SECTION CONTAINS CRITICAL DISCLOSURES REQUIRED BY LAW AND Beacon Tax Relief LLC POLICY.
3.1 No Circular 230 Practice
Beacon Tax Relief LLC is NOT a Circular 230 practitioner and does not engage in "practice before the Internal Revenue Service" as defined by 31 CFR Part 10. Under Circular 230, only licensed attorneys, certified public accountants (CPAs), and enrolled agents (EAs) may represent taxpayers before the IRS, negotiate settlements, or appear in IRS proceedings. Beacon Tax Relief LLC staff are not licensed attorneys, CPAs, or enrolled agents, and will not act in any capacity that constitutes Circular 230 practice.
3.2 No Power of Attorney (Form 2848)
Beacon Tax Relief LLC will never hold, execute, or act under IRS Form 2848 (Power of Attorney and Declaration of Representative) for any customer. Form 2848 authorizes representation before the IRS and may only be executed by Circular 230 practitioners. No Beacon Tax Relief LLC staff member will sign, use, or act under a Form 2848.
3.3 You Make All Decisions
All decisions regarding IRS programs to pursue, information to provide to the IRS, forms to file, amounts to offer, and all other tax-related decisions are yours alone. The Service provides tools and information to help you make these decisions; it does not make them for you. You are solely responsible for all decisions made using the Service.
3.4 You Sign and Submit Everything
Every document, form, letter, or submission generated by the Service must be reviewed, signed, and submitted by you. Beacon Tax Relief LLC does not submit documents to the IRS on your behalf, does not sign documents on your behalf, and is not responsible for documents you submit.
3.5 Consult a Licensed Professional
For legal representation before the IRS, negotiation of settlements, or complex tax matters involving litigation or criminal tax issues, you should engage a licensed attorney, CPA, or enrolled agent. Nothing in these Terms or in your use of the Service prevents you from engaging such a professional.
4. Subscription Terms — Billing, Cancellation, and Refunds
4.1 Billing
(a) Recurring Billing. Subscriptions are billed on a recurring monthly basis (or annual basis for annual plans, where offered). By providing payment information and subscribing, you authorize Beacon Tax Relief LLC to charge your payment method for each billing cycle until you cancel.
(b) Billing Date. Your billing cycle begins on the date you subscribe. Subsequent charges occur on the same calendar date each month (or year for annual plans). If your billing date falls on a date that does not exist in a given month (e.g., the 31st), you will be billed on the last day of that month.
(c) Price Changes. Beacon Tax Relief LLC may change subscription prices upon 30 days' advance notice to your registered email address. Continued use of the Service after a price change takes effect constitutes acceptance of the new price.
(d) Taxes. Prices do not include applicable sales taxes, use taxes, or similar charges. You are responsible for any applicable taxes based on your location.
(e) Failed Payments. If your payment fails, Beacon Tax Relief LLC will attempt to retry the charge. If payment remains outstanding for [7] days, your account may be suspended. Access to your data is retained for [90] days after suspension to allow reactivation.
4.2 Cancellation
(a) How to Cancel. You may cancel your subscription at any time through your account dashboard at [WEBSITE_URL]/account/cancel, or by emailing [SUPPORT_EMAIL] with your cancellation request. Cancellation takes effect at the end of your current billing period. You will retain access to the Service through the end of the period for which you have paid.
(b) No Cancellation Fees. There is no fee for cancellation.
(c) Data After Cancellation. Upon cancellation, your account will be downgraded to a free read-only mode for [90] days, after which your data will be deleted in accordance with our data retention policy (see Privacy Policy). You may export your data at any time before deletion.
4.3 Refund Policy
(a) 14-Day Money-Back Guarantee — First Month Only. If you are a first-time subscriber, you may request a full refund of your first month's subscription fee within 14 days of your initial subscription purchase. To request a refund, email [SUPPORT_EMAIL] with the subject line "Refund Request" within 14 days of purchase. Refunds will be processed within 10 business days. This money-back guarantee applies only to your first subscription purchase and only within the 14-day window.
(b) No Refunds After 14 Days. After the 14-day money-back window expires, subscription fees are non-refundable. This includes mid-period cancellations — if you cancel before the end of a monthly billing period, you will not receive a prorated refund for unused days.
(c) Annual Plans. Annual subscription fees are prorated on a refund basis only if cancelled within 30 days of the annual renewal date. After 30 days, no refund is available. Prorated refunds for annual plans are calculated based on unused complete months remaining at the time of cancellation.
(d) Full details of the Refund Policy are set forth in the separate Refund Policy document available at [WEBSITE_URL]/refund-policy, which is incorporated herein by reference.
5. Document Packs
5.1 What Document Packs Are
Beacon Tax Relief LLC offers one-time Document Pack purchases priced at $99–$249 per pack. Each Document Pack is a collection of pre-generated IRS forms, letters, and supporting documents tailored to a specific IRS resolution program or scenario (e.g., "OIC Starter Pack," "Installment Agreement Pack").
5.2 Document Pack Terms
(a) One-Time Purchase. Document Pack purchases are one-time transactions, not subscriptions. No recurring charge occurs.
(b) Refund — Pre-Generation Only. Refunds for Document Packs are available only if the pack has not yet been generated. Once a Document Pack is generated (i.e., once your documents are created by the system using your entered data), the purchase is final and no refund will be issued, regardless of the reason.
(c) Generation Trigger. Document Pack generation begins when you click "Generate Pack" or equivalent action. Once initiated, the pack is considered generated even if you do not download it.
(d) Not Completed Forms. Document Packs are templates populated with your provided data. They are NOT completed, finalized, or IRS-ready submissions. You must review each document for accuracy, consult a qualified professional as appropriate, and sign all documents before submitting to the IRS.
(e) Accuracy. You are solely responsible for the accuracy of information you provide when generating a Document Pack. Beacon Tax Relief LLC is not responsible for errors, omissions, or incorrect information in generated documents that arise from inaccurate data you provided.
6. Acceptable Use
6.1 Permitted Uses
You may use the Service only for lawful purposes and in accordance with these Terms. Permitted uses include: organizing your own tax-related financial information, generating documents related to your own IRS matters, and accessing educational content about IRS programs.
6.2 Prohibited Uses

7. IRC §7216 Consent Reference
7.1 AI Processing of Tax Information
Beacon Tax Relief LLC uses artificial intelligence tools, including services provided by Anthropic PBC and OpenAI Inc., to power certain features of the Service. If you provide tax return information (as defined under IRC §7216) through the Service, your information may be processed by these AI providers as described in our Privacy Policy and the IRC §7216 Consent document.
7.2 Consent Required
Federal law (IRC §7216) prohibits tax return preparers from disclosing or using tax return information without taxpayer consent. Where §7216 applies to our operations, we obtain your affirmative written consent before any such disclosure. The consent is embodied in the separate IRC §7216 Consent and Authorization document presented at signup, which you must affirmatively agree to before AI-assisted features are enabled.
7.3 Scope of AI Processing
AI processing of your tax information is used solely for the purpose of providing you with the Service features you have requested. Neither Beacon Tax Relief LLC nor its AI providers will use your tax return information to train AI models, except as specifically consented to by you. (c) The IRS will accept, process, or approve any form, offer, or request prepared with the assistance of the Service;
(d) Information provided by AI tools is accurate, complete, or current;
(e) The Service will meet your specific tax resolution goals or achieve any particular outcome.
ALL RELIANCE ON THE SERVICE IS AT YOUR OWN RISK. FOR LEGAL REPRESENTATION AND PROFESSIONAL JUDGMENT ON YOUR SPECIFIC SITUATION, ENGAGE A LICENSED ATTORNEY, CPA, OR ENROLLED AGENT.
10. Limitations of Liability
10.1 Cap on Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Beacon Tax Relief LLC 'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO Beacon Tax Relief LLC IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
10.2 Exclusion of Consequential Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Beacon Tax Relief LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOSS OF GOODWILL, PENALTIES IMPOSED BY THE IRS OR ANY TAXING AUTHORITY, INTEREST ACCRUAL ON TAX DEBT, OR LOSS OF OPPORTUNITY, EVEN IF Beacon Tax Relief LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10.3 Essential Basis
You acknowledge that these limitations of liability reflect a reasonable allocation of risk between the parties and are an essential element of the basis of the bargain between you and Beacon Tax Relief LLC . Without these limitations, Beacon Tax Relief LLC would not be able to provide the Service at these prices.
10.4 State Law Variations
Some jurisdictions do not allow exclusion of implied warranties or limitation of liability for certain types of damages. In such jurisdictions, Beacon Tax Relief LLC 's liability will be limited to the greatest extent permitted by applicable law. If you are located in such a jurisdiction, some of the exclusions above may not apply to you.
11. Indemnification
You agree to defend, indemnify, and hold harmless Beacon Tax Relief LLC , its officers, directors, employees, contractors, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
(a) Your use of the Service in violation of these Terms;
(b) Your violation of any applicable law, including tax laws, in connection with documents generated using the Service;
(c) Any inaccurate or fraudulent information you provided to the Service;
(d) Any claim by a third party arising from your use of the Service;
(e) Any IRS penalties, interest, or assessments arising from your use of documents generated by the Service.
12. Dispute Resolution — Mandatory Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO BRING A LAWSUIT IN COURT AND YOUR RIGHT TO A JURY TRIAL.
12.1 Informal Resolution First
Before initiating arbitration, you agree to first attempt to resolve any dispute informally by contacting [SUPPORT_EMAIL] with a written description of the dispute. We will attempt to resolve the dispute within 30 days of receipt.
12.2 Mandatory Arbitration
If informal resolution fails, any dispute, controversy, or claim arising out of or relating to these Terms or the Service, including questions about their scope, enforceability, or interpretation, shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except as stated in Section 12.5 below.
Arbitration shall take place in [CITY, TEXAS] or, at your election, by telephone or video conference. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
12.3 Class Action Waiver
YOU AND Beacon Tax Relief LLC EACH AGREE THAT ANY CLAIM SHALL BE BROUGHT IN YOUR OR OUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims, may not preside over any form of class or representative proceeding, and may not award class-wide relief.
Note on State Law Variations: Class action waivers may be unenforceable in certain states or in certain contexts under applicable consumer protection laws. This waiver will be enforced to the maximum extent permitted by applicable law. If a class action waiver is found unenforceable with respect to a particular claim, that claim may proceed in court, but all other claims remain subject to arbitration.
12.4 Arbitration Fees
For claims under $10,000, Beacon Tax Relief LLC will pay all AAA filing, administrative, and arbitrator fees. For claims over $10,000, fees are allocated per the AAA Consumer Arbitration Rules.
12.5 Exceptions
Either party may bring a claim in small claims court for disputes within that court's jurisdiction. Either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration. This Section does not apply to claims for injunctive relief related to intellectual property violations.
12.6 Opt-Out Right
You may opt out of this arbitration agreement by sending written notice to [SUPPORT_EMAIL] within 30 days of your initial account creation. Your notice must include your name, account email, and a clear statement that you wish to opt out of arbitration. Opting out does not affect any other provision of these Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles. Subject to the arbitration agreement in Section 12, you consent to personal jurisdiction and venue in the state and federal courts located in [COUNTY, TEXAS].
14. Changes to These Terms
Beacon Tax Relief LLC may modify these Terms from time to time. We will provide notice of material changes by:
(a) Posting the updated Terms on our website with a new "Last Updated" date; and
(b) Sending an email to your registered email address at least 30 days before the changes take effect (for material changes).
Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and cancel your subscription before the effective date.
15. General Provisions
15.1 Entire Agreement
These Terms, together with the Privacy Policy, IRC §7216 Consent, Refund Policy, and any applicable subscription-tier agreements, constitute the entire agreement between you and Beacon Tax Relief LLC regarding the Service and supersede all prior agreements.
15.2 Severability
If any provision of these Terms is found unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force.
15.3 Waiver
No waiver of any provision of these Terms shall be effective unless in writing. Failure to enforce any provision does not constitute a waiver of future enforcement.
15.4 Assignment
You may not assign these Terms or any of your rights or obligations without Beacon Tax Relief LLC 's prior written consent. Beacon Tax Relief LLC may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of its assets.
15.5 Force Majeure
Beacon Tax Relief LLC is not liable for delays or failures in performance resulting from causes beyond its reasonable control, including acts of God, natural disasters, government actions, or IRS system outages.
15.6 No Attorney-Client Relationship
Use of the Service does not create an attorney-client relationship between you and Beacon Tax Relief LLC or any of its staff.
